1. Introduction

Welcome to InStoore. These Terms of Service ("Terms") govern your use of our website located at www.instoore.com (the "Service") operated by InStoore ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms, which are designed in compliance with Moroccan laws including Law 31-08 on Consumer Protection Measures, Law 09-08 on Personal Data Protection, Law 53-05 on Electronic Exchange of Legal Data, and other applicable regulations. If you disagree with any part of these terms, you may not access the Service.

2. Use of the Service

2.1 Account Registration

In order to use certain features of the Service, you must register for an account and provide accurate information as prompted by the registration form. By creating an account, you certify that:

You are at least 18 years of age or accessing the Service under the supervision of a parent or legal guardian
All registration information you submit is truthful and accurate
You will maintain the accuracy of such information
Your use of the Service does not violate any applicable law or regulation

3. Marketplace Policies

3.1 For Buyers

When you make a purchase or engage with stores on InStoore, you agree to:

Provide accurate and complete information including delivery address and contact details
Confirm receipt of products in a timely manner
Communicate respectfully with store owners
Leave honest and fair reviews based on actual experiences
Report any issues with orders promptly through our platform
Comply with all applicable laws and regulations

3.2 For Store Owners

When you operate a store on InStoore, you agree to:

Provide accurate and complete information about your business and products
Ensure product descriptions and pricing are truthful and not misleading
Maintain adequate inventory of listed products
Process and fulfill orders promptly according to the stated timeframes
Respond to customer inquiries within 48 hours
Comply with all applicable laws and regulations, including tax obligations
Handle customer data in accordance with Moroccan Law 09-08 on Personal Data Protection
Keep store information up-to-date including contact details, business hours, and location

3.3 Product Listings

All products listed on InStoore must:

Be described accurately including dimensions, materials, and usage instructions
Include clear images that accurately represent the product
Display all prices in Moroccan Dirhams (MAD) including applicable taxes
Not violate any intellectual property rights
Not be prohibited by Moroccan law
Include country of origin information where applicable

4. Delivery and Returns

4.1 Delivery

Delivery terms are as follows:

Delivery timeframes and costs are provided at the time of order placement
Delivery fees may vary based on location and product characteristics
The buyer is responsible for providing accurate delivery information
Delivery may require location coordinates in certain areas

4.2 Returns and Refunds

In accordance with Law 31-08 on Consumer Protection Measures:

Buyers have the right to return products within 7 days of receipt without providing a reason
Products must be returned in original condition with all packaging and accessories
Some products may be exempt from returns including personalized items and perishables
Return shipping costs may be the responsibility of the buyer unless the product is defective
Refunds will be processed within 14 days of receiving the returned product

Individual stores may offer more generous return policies at their discretion.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of InStoore and its licensors. The Service is protected by copyright, trademark, and other laws of Morocco and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of InStoore.

5.1 User Content

Users retain ownership of the content they post on the platform. However, by posting content, you grant InStoore a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and distribute such content on our Service.

5.2 Infringement Claims

If you believe that material available on our Service infringes on your copyright, please notify us at ip@instoore.com. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

6. Prohibited Uses

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that violates any applicable law or regulation
To impersonate or attempt to impersonate another person or entity
To engage in any conduct that restricts or inhibits anyone's use of the Service
To attempt to gain unauthorized access to any part of the Service

To engage in any activity that could damage the reputation of InStoore or its users

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

8. Limitation of Liability

In accordance with Moroccan law, InStoore shall not be liable for:

Indirect, incidental, special, or consequential damages arising from your use of the Service
Any loss of profit, revenue, data, or business opportunities
Any content posted by users of the Service
Any unauthorized access to or use of our servers or personal information
Any interruption or cessation of transmission to or from the Service

This limitation does not apply to our liability for fraud, willful misconduct, or for death or personal injury caused by our negligence or any other liability that cannot be excluded or limited by Moroccan law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

11. Data Protection

Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using the Service, you consent to the collection and use of information in accordance with this policy.
